Challenging Election Commissions
"I want to share one reflection on, as usual, the not-so-interesting topic of elections. Or rather, not the elections themselves, but the challenging of the actions of election commissions at the stage of registering candidates and parties.
The Kommersant newspaper I receive in the pre-trial detention center quite often covers cases related to the consideration of some complaints of political parties and candidates by the Constitutional Court (CC). Moreover, the court often sides with the applicants and makes surprisingly adequate decisions. Thus, relatively recently, the refusal to register one of the independent candidates at the municipal elections in Moscow in 2022 was declared illegal. And a very recent story: in March, the CC declared illegal the removal of Yabloko party lists at the municipal elections in the Pskov region in 2023. (I write without details, because if I describe all this here, you will unsubscribe from me. For those interested, here is an article in Kommersant and the official statement of Yabloko).
It's amazing, adequacy sometimes wins. The CC even recognized Yabloko's right to compensation. But the point is not in the compensation, which in such cases is usually a penny, but in the fact that a year and a half has already passed since the elections themselves, from participation in which the party was deprived, and in which voters were limited in their right to choose. Of course, no one will hold new elections because of this, this electoral train has long gone. And that is why, it seems, the CC can afford some adequacy when making decisions, because this will no longer affect the results of the past elections, they were successfully held without a dangerous opposition. Yes, these court decisions can play a certain role in future campaigns, but they still need to be conveyed to election commissions and local courts, and there we will again see a vicious circle requiring new complaints to the CC. After all, officials responsible for internal politics know and put into practice the well-known rule: one who is not on the ballot cannot be elected.

«Хочу поделиться одним соображением на, как обычно, не самую интересную тему выборов. А точнее даже не самих выборов, а оспаривания действий избирательных комиссий на этапе регистрации кандидатов и партий.
В получаемой мной в СИЗО газете "КоммерсантЪ" довольно часто освещаются дела, связанные с рассмотрением некоторых жалоб политических партий и кандидатов Конституционным судом (КС). Причем суд часто встает на сторону заявителей и выносит на удивление адекватные решения. Так, относительно недавно был признан незаконным отказ в регистрации одному из независимых кандидатов на муниципальных выборах в Москве в 2022 году. И совсем свежая история: в марте КС признал незаконным снятие партийных списков "Яблока" на муниципальных выборах в Псковской области в 2023 году. (Пишу без подробностей, потому что если буду все это здесь описывать, то вы от меня отпишетесь. Кому интересно, вот статья в "Ъ" и официальное заявление "Яблока").
Удивительное дело, адекватность порой побеждает. КС даже признал право "Яблока" на компенсацию. Но дело ведь не в компенсации, которая в таких случаях обычно копеечная, а в том, что с самих выборов, участия в которых партии была лишена, и на которых избиратели были ограничены в своем праве выбора, прошло уже полтора года. Новых выборов никто, разумеется, из-за этого проводить не будет, этот электоральный поезд давно ушел. И именно поэтому, как кажется, КС может позволить себе некоторую адекватность при вынесении решений, ведь результаты состоявшихся выборов это уже не затронет, они успешно состоялись и без опасной оппозиции. Да, эти судебные решения могут сыграть определенную роль на следующих кампаниях, но так их ведь надо еще донести до избиркомов и судов на местах, а там мы вновь увидим порочный круг, требующий новых жалоб в КС. Ведь чиновники, ответственные за внутреннюю политику, знают и применяют на практике известное правило: избраться не может тот, кого нет в бюллетене.
